Proposed Letter to Tom Harker (updated 4/17/98)

Tom,

This letter is not a threat.  It is simply informative.  I thought I would
give you some inkling as to what is going on in the Atari community at this
moment.

I have been made aware of other people who have ordered Catboxes and other
Atari products from ICD who have not received them as of yet.  Their e-mail
and phone messages are continually being ignored, and frankly they are
getting very angry.  Several of them are filing complaints with the
Attorney General's office.  I plan on filing a complaint as well, even
though I received my product, because of the ineptness of your company to
follow through with your obligations as a business.

You said to me on the phone that this was a "favor" that ICD was doing for
Atari Jaguar owners.  You forget that once you take another person's money
that it is no longer a "favor" but a business transaction and you are
obliged to treat it as such.  No matter if you are losing money or not, you
are bound legally to deliver the product in a timely fashion for this is
the agreement you have made implicitly by accepting the customer's money. 
Any other interpretation constitutes fraud.

You should be aware that the Atari community, while they may appreciate a
second wind of Atari products, demands that they be treated with the same
courtesy as any other "big business" partner is.  You have agreed to
produce and deliver, and legally you must.

If you have any questions about the validity of this argument, I suggest
you get in contact with your legal representative.  I think that he or she
would agree that a business contract as implied by the exchange of money is
a binding agreement for you.  Consider this as you continue to refuse to
communicate to your customers.
